Terms of Service
These terms apply to all orders placed through newtonfarmfoods.co.uk. By placing an order you agree to them. Please read them before you buy. Your statutory rights as a consumer are not affected.

In these terms, "we", "us" and "our" mean Newton Farm Foods. "You" means the person placing the order.
2. Eligibility
By placing an order you confirm that you are at least 18 years old and ordering for delivery to an address in mainland United Kingdom. We do not deliver outside this area.
Alcohol sales. It is an offence under the Licensing Act 2003 to sell alcohol to anyone under the age of 18. Where your order contains alcohol, you confirm that both you and the person receiving the delivery are aged 18 or over. We operate a Challenge 25 policy: the delivery driver may require proof of age (a valid passport, photographic driving licence or PASS-accredited card) from anyone who appears to be under 25. If satisfactory proof cannot be provided, or if no one aged 18 or over is present to accept the delivery, the alcohol will not be left and you will be charged a £10 redelivery fee or refunded for the alcohol items only (at our discretion).
3. Placing an order
When you place an order through our website, you are making an offer to buy from us. Your order is acknowledged by an automated email, but this email is not acceptance of your order.
A binding contract is formed only when we send you an email confirming that your order has been dispatched (or, for click-and-collect, that your order is ready to collect).
We may refuse or cancel any order at our discretion before this point, including (without limitation) where:
- a product is out of stock;
- a product was listed at an incorrect price or description due to an error;
- we are unable to verify your identity, payment or delivery address;
- we suspect fraud or misuse of the website;
- delivery to your address is not practicable.
If we cancel your order before dispatch, we will refund any payment taken in full.
4. Prices, errors and VAT
All prices are in pounds sterling and, where VAT applies, include VAT at the prevailing rate. Delivery charges are shown separately at checkout.
We try to ensure that all prices and product information on the website are accurate. Where an error is identified before we accept your order, we may cancel the affected items and refund you. We are not obliged to supply products at an incorrect price.
5. Payment
Payment is taken in full at the time you place your order. We accept the payment methods shown at checkout. Your order will not be processed until payment has cleared.
6. Delivery and collection
Estimated delivery dates and time slots are shown at checkout. These are estimates only and are not guaranteed.
Risk in the goods passes to you on delivery (or, for click-and-collect, on collection). Title in the goods passes to you when we have received payment in full.
If no one is available to take delivery and the courier is unable to leave the goods safely, you must arrange redelivery or collection within the timeframe given by the courier. We are not responsible for goods that deteriorate as a result of a missed or refused delivery.
7. Cancellation, returns and refunds
Cancellation rights, returns and refunds are dealt with in our Refund Policy, which forms part of these terms.
In summary: perishable goods cannot be cancelled or returned for change of mind. For all goods, your rights under the Consumer Rights Act 2015 (satisfactory quality, fit for purpose, as described) apply.
8. Allergens and product information
We make reasonable efforts to ensure that product descriptions, ingredients and allergen information on the website are accurate. You must check product labels and packaging on receipt before consuming. If you have a serious allergy, intolerance or medical condition, do not rely on website information alone — contact us before ordering.
9. Acceptable use
You may use this website only for lawful purposes. You may not:
- use the website in any way that breaches any applicable law;
- introduce any virus, malware or harmful code;
- attempt to gain unauthorised access to the website, the server, or any related system;
- copy, reproduce or republish any content on the website without our written permission.
10. Our liability
Nothing in these terms limits or excludes our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- any other liability that cannot be excluded under English law.
Subject to the above, our total liability to you arising out of or in connection with any order is limited to the price you paid for that order.
We are not liable for any indirect or consequential loss, loss of profit, loss of business, loss of goodwill, or any loss arising from your failure to follow product labelling, storage or preparation instructions.
11. Events outside our control
We are not liable for any delay or failure to perform our obligations where this is caused by events outside our reasonable control, including (without limitation) extreme weather, livestock disease, supplier failure, courier failure, industrial action, fire, flood, or government action.
12. Privacy
We process personal data in accordance with our Privacy Policy.
13. Intellectual property
All content on this website (including text, images, logos and product descriptions) is owned by us or our licensors. You may not use it for any commercial purpose without our written permission.
14. Changes to these terms
We may update these terms from time to time. The version in force when you place your order is the version that applies to that order. The current version is always available on the website.
15. Governing law and jurisdiction
These terms are governed by the laws of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.
